Considerable changes for the constructions outside the town planning.

The Ministry of Environment announced considerable changes for the constructions outside the town planning, as per the multi-bill recently put up for public consultation. The multi-bill aims to abolish all exceptions and derogations in the rules on the constructions outside the town planning, within the next two years.

This bill pursues to gradually limit the construction in areas outside the town-planning, for which there is currently no urban plan. At the same time, it is encouraged the organized development and provides incentives for the concentration of activities in organized reception areas.

It proposes the abolition of all the loopholes, which under certain conditions allow for the construction in plots as small as 2,000 sqm, 1,200 sqm, or even 750 sqm. The minimum plot size, where construction will still be allowed, will be 4,000 sqm., while, especially for tourism installations, the minimum plot allowed will range from 4,000sqm (for some specific areas and in buildings with bioclimatic characteristics) to 8,000sqm. This rule will not apply to a series of buildings such as “upgraded hotels” (a new category that also includes holiday homes), logistics facilities, and healthcare installations, among others.

These provisions of the bill will enter into force two years after its enactment, thus giving time to landowners to issue a building permit, per current provisions.

At the same time, the building coefficients for the plots outside the town planning are reduced, with the reduction reaching on average up to 10% for residences, while the coefficients are increased up to 25% in organized development, tourism, housing, and business (e.g. in complex tourist accommodation).
